Terms of Engagement

By booking a discovery call or purchasing any service from The Potential House Studio Ltd (“we”, “us”, or “The Potential House”), you agree to the following terms and conditions:
1. Our Services
The Potential House provides architect-led consultancy to help clients understand a property’s design potential, planning context, and renovation risks before purchase. Services may include:
Discovery calls to discuss your plans and explain our services.
Desktop appraisals based on information provided remotely.
Pre-purchase appraisals including site visits and a short written summary.
Our services do not include measured surveys, detailed design drawings, planning applications, structural assessments, cost estimates, or legal advice.
2. Advisory Nature of Our Services
All advice provided by The Potential House is advisory only and is based on the information available to us at the time. It is intended to support your decision-making, but it is not a guarantee of planning approval, statutory regulations, construction feasibility, or final project outcomes.
Our services do not replace the need for independent surveys, legal due diligence, or specialist reports.
Any subsequent services, if agreed, do not constitute validation or endorsement of decisions made prior to appointment.
3. Impartiality and Follow-On Services
The Potential House aims to provide clear, professional and objective advice at the pre-purchase stage, focused on helping clients make informed decisions.
We do not actively seek follow-on design or architectural appointments as part of our pre-purchase services, and any advice given is intended to stand independently of future work.
In some circumstances, and only following completion of the appraisal and at the client’s request, we may agree to provide further architectural or design services under a separate appointment, fee proposal and terms of engagement.
Where follow-on services are provided, they will be subject to their own scope, fees and contractual terms, and will not alter the advisory nature of the original appraisal.
4. Payment and Cancellations
Discovery calls are free of charge.
All paid services are payable in full at the time of booking.
Cancellations made more than 7 days before a scheduled consultation will be refunded minus a £50 administration fee.
Cancellations made less than 7 days before the appointment are non-refundable.
Rescheduling is possible at our discretion and subject to availability.
5. Client Responsibilities
You agree to:
Provide accurate and complete information about the property.
Obtain permission for site access (if applicable).
Acknowledge that our advice is based on the information you provide and may change if new details emerge.
Accept full responsibility for any decisions you make based on our advice.
6. Liability
Our total liability to you, whether in contract, tort (including negligence), or otherwise, will not exceed the fee paid for the service in question.
We are not liable for any indirect or consequential losses, including loss of profit, project delays, or reduced property value.
Your property purchase decisions remain your responsibility.
7. Subcontractors
In some cases, we may subcontract the delivery of services to other registered architects. These professionals are required to hold their own professional indemnity insurance.
We remain the contracting party and responsible for the overall delivery of the service.
8. Intellectual Property
All written reports, sketches, and other materials we provide remain our intellectual property.
You are granted a non-exclusive licence to use them for your own property decision-making.
They must not be shared or published without our written permission.
9. Confidentiality
We will treat all information you provide as confidential and will not share it with third parties without your consent, except as required by law.
10. Governing Law
This agreement is governed by and construed in accordance with the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the English courts.
